3. User Responsibilities

  • Providing Accurate KYC Information: Users must provide valid Government-issued ID details (such as PAN or Voter ID) for identity verification if requested. Any attempt to submit false information may lead to account termination and legal action.
  • Consent to eKYC Verification: Users must explicitly consent to eKYC verification before availing services if requested by the system. Identity details will only be used for fraud prevention, chargeback mitigation, legal compliance, and service improvement.
  • Age Confirmation: eKYC verification is also used to confirm that the user is 18 years or older. Users under 18 are not permitted to use the services.

4. Account Management

  • Age Requirement: Users must be at least 18 years old to create an account on our Site.
  • Account Security: You are responsible for maintaining the confidentiality of your sign-in credentials. Bharat Bargains will not be held liable for any unauthorized access resulting from your failure to protect your sign-in information.
  • eKYC Requirement: Users can create an account without eKYC, but in certain cases, our system may trigger a verification request. Until eKYC is completed, the user will have limited account functionality.
  • Security of eKYC Data: Identity details will be encrypted and securely stored in compliance with applicable data protection laws.
  • Minor Detection: If a user undergoes eKYC verification and is found to be a minor, their account will be restricted from accessing our services. Any refund of remaining wallet balances is subject to Bharat Bargains' sole discretion. Payments made towards products/services already delivered will absolutely not be refunded.

5. Content and Intellectual Property

Ownership: All content, trademarks, logos, and intellectual property on the Site are owned by Bharat Bargains or its licensors. You may not use, reproduce, distribute, or modify any content without prior written permission.

6. eKYC Verification and Data Usage

Conditional eKYC: KYC verification is not mandatory for all users. However, in cases of high-value transactions or suspicious activity, our system may request verification.

Data Security: Identity details are encrypted and securely stored. Bharat Bargains does not share this data with third parties, except as required by RBI, banks, or government authorities.

Usage of eKYC Data: If collected, we use eKYC data for identity verification, fraud prevention, chargeback mitigation, age verification, and improving our services.

Refusal to Provide eKYC: Users who refuse eKYC verification in cases where it is triggered will not be allowed to access services that require it.

7. Prohibition of Third-Party Payments

Strict Account Matching: All transactions must be completed using payment methods (UPI, bank accounts, credit/debit cards) legally registered in the exact same name as the Bharat Bargains account holder. The use of third-party payment methods is strictly prohibited.

Unauthorized and Minor Usage: You are solely responsible for preventing unauthorized access to your payment instruments. We do not accept liability for claims of unauthorized transactions made by minors (e.g., children using parents' accounts), relatives, or friends. The registered account holder assumes full legal and financial liability for all transactions processed through their account.

Account Termination: If our system detects a transaction originating from a third-party source, or if a dispute or chargeback is raised citing unauthorized use by a family member or third party, Bharat Bargains reserves the right to immediately suspend or permanently terminate your account without prior notice.

No Refunds and Legal Action: In the event of account termination due to a violation of this third-party payment policy, no refunds will be issued for any pending orders, account balances, or disputed amounts. We reserve the right to retain these funds to offset chargeback liabilities and may report suspicious activities to our banking partners, the RBI, or law enforcement authorities to protect against fraud.

8. Data Retention and Deletion Policy

Transaction History Access: To optimize system performance and enhance data security, your order details, invoices, and payment transaction history will only remain visible and accessible on your Bharat Bargains account dashboard for a maximum period of three (3) months from the transaction date.

User Record-Keeping Responsibility: Customers are solely responsible for downloading and saving their invoices, payment receipts, and order summaries within this 3-month window. Once this period expires, this data will be automatically removed from your user-facing account and cannot be retrieved or provided by our customer support team.

Statutory Backend Retention: Please note that while transaction data is removed from your active account dashboard after 3 months, Bharat Bargains is legally obligated under Indian taxation laws, RBI guidelines, and the Prevention of Money Laundering Act (PMLA) to securely archive backend records of financial transactions and associated KYC data. This archived data is not accessible to the user but is retained strictly for regulatory compliance, fraud prevention, audits, and resolving legal disputes.

Account Deletion Requests: If you choose to permanently delete your Bharat Bargains account, your profile information will be erased. However, records of any past financial transactions will still be retained in our secure backend for the legally mandated period before being permanently destroyed.

9. Payment and Transactions

Payment Methods: We accept various payment methods, including UPI, credit/debit cards, and wallet points.

Billing Information: You agree to provide accurate billing information for all transactions on our Site.

10. Wallet Terms

By using the wallet feature on our website, users agree to abide by the terms and conditions outlined herein.

  • Currency Conversion: The conversion rate for wallet recharge is fixed at 1 INR = 1 BCS (Bharat Bargains Credits) and is subject to change at our discretion.
  • No Interest: Wallet funds do not accrue interest and are solely for the purpose of making purchases on https://bharat-bargains.com/.
  • Non-Transferable: Wallet funds cannot be transferred to other users or accounts, and they are non-transferable to any other platform or website.
  • Wallet Security: Users are responsible for maintaining the security and confidentiality of their wallet credentials.
  • Transaction Limits: We reserve the right to impose transaction limits on wallet usage at our discretion.
  • Refunds: Wallet recharge amounts are strictly non-refundable to your bank account. If a transaction fails, wallet points equivalent to the purchase amount will be refunded to your wallet.

13. Termination

We reserve the right to terminate your account and access to the Site if you are involved in any fraudulent or illegal activities. Termination notices will be sent via email or phone message. Any remaining wallet points will generally not be refunded upon account termination, subject to review at our discretion.

Accounts found submitting fraudulent identity details will be terminated immediately. If a chargeback is raised fraudulently, we will share verified identity details with banks and authorities for legal proceedings.

14. Dispute Resolution and Compliance

Arbitration: Any dispute, controversy, or claim arising out of or relating to this contract, or the breach, termination, or invalidity thereof, shall be decided by arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996. The appointing authority shall be the Indian Council of Arbitration or any other recognized arbitration institution in India. The arbitration proceedings shall be conducted in English.

Jurisdiction: You agree to submit any dispute, controversy, or claim arising out of or in connection with the Services to the exclusive jurisdiction of the courts of India.

Compliance: You are responsible for ensuring compliance with all applicable laws, including cross-border transaction regulations where relevant.

15. Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our website and the use of this website. Nothing in this disclaimer will limit or exclude our or your liability for death or personal injury, limit or exclude our or your liability for fraud or fraudulent misrepresentation, limit any of our or your liabilities in any way that is not permitted under applicable law, or exclude any of our or your liabilities that may not be excluded under applicable law.
