3. User Responsibilities

As a user of Bharat Bargains, you are responsible for:

Providing Accurate Information: Ensuring that all information provided during registration and account maintenance is accurate and up-to-date.
Lawful Use: Using our services in compliance with all applicable laws and regulations.
Prohibited Activities: Avoiding activities such as fraud, illegal transactions, or any other harmful conduct. Accounts involved in such activities will be terminated.
Providing Accurate KYC Information (if required): Users must provide valid Aadhaar and PAN details for identity verification if requested. Any attempt to submit false information may lead to account termination and legal action.
Consent to eKYC Verification (if required): Users must explicitly consent to eKYC verification before availing services if requested by the system. Aadhaar and PAN details will only be used for fraud prevention, chargeback mitigation, legal compliance, and service improvement.
Age Confirmation: eKYC verification (if triggered) is also used to confirm that the user is 18 years or older. Users under 18 are not permitted to use the services.

4. Account Management

Age Requirement: Users must be at least 18 years old to create an account on our Site.
Account Security: You are responsible for maintaining the confidentiality of your sign in credentials. Bharat Bargains will not be held liable for any unauthorized access resulting from your failure to protect your sign in information.
eKYC Requirement: Users can create an account without eKYC, but in certain cases, such as high-value transactions or suspicious activity, our system may trigger a verification request for security reasons. Until eKYC is completed, the user will have limited account functionality.
Security of eKYC Data: Aadhaar and PAN details (if collected) will be encrypted and securely stored in compliance with applicable data protection laws.
Refund Policy for Minor Detection: If a user undergoes eKYC verification and is found to be a minor, their account will be restricted from accessing our services. If the user had previously loaded funds into their Bharat Bargains wallet, the remaining balance will be refunded. However, payments made towards products/services already delivered will not be refunded.

5. Content and Intellectual Property

Ownership: All content, trademarks, logos, and intellectual property on the Site are owned by Bharat Bargains or its licensors. You may not use, reproduce, distribute, or modify any content without prior written permission.
User Content: Any content submitted by users, including reviews or comments, may be used by Bharat Bargains for marketing or promotional purposes.

6. eKYC Verification and Data Usage

Conditional eKYC: KYC verification is not mandatory for all users. However, in cases of high-value transactions or suspicious activity, our system may request verification.
Data Security: Aadhaar and PAN details (if collected) are encrypted and securely stored. Bharat Bargains does not share this data with third parties, except as required by RBI, banks, or government authorities.
Usage of eKYC Data: If collected, we use eKYC data for:

- Fraud prevention and chargeback mitigation
- Age verification (ensuring the user is 18 or older)
- Improving our services
Consent: By submitting Aadhaar and PAN details, users explicitly consent to data collection, storage, and usage for the above purposes if required.
Refusal to Provide eKYC (if requested): Users who refuse eKYC verification in cases where it is triggered will not be allowed to access services that require it.

7. Payment and Transactions

Payment Methods: We accept various payment methods, including UPI, credit/debit cards, and wallet points.
Billing Information: You agree to provide accurate billing information for all transactions on our Site.

8. Wallet

Wallet Usage: By using the wallet feature on our website, users agree to abide by the terms and conditions outlined herein.
Currency Conversion: The conversion rate for wallet recharge is fixed at 1 INR = 1 BC (Bharat Bargains Credits) and is subject to change at our discretion.
No Interest: Wallet funds do not accrue interest and are solely for the purpose of making purchases on https://bharat-bargains.com/.
Non-Transferable: Wallet funds cannot be transferred to other users or accounts, and they are non-transferable to any other platform or website.
Wallet Security: Users are responsible for maintaining the security and confidentiality of their wallet credentials. Any unauthorized use or access to the wallet should be reported immediately to us.
Transaction Limits: We reserve the right to impose transaction limits on wallet usage at our discretion.
Modification of Terms: We reserve the right to modify, suspend, or terminate the wallet feature or its terms and conditions at any time without prior notice.
Refunds: Wallet recharge amounts are non-refundable. If a transaction fails, wallet points equivalent to the purchase amount will be refunded to your wallet, not your bank account.

11. Limitation of Liability

12. Termination

We reserve the right to terminate your account and access to the Site if you are involved in any fraudulent or illegal activities. Termination notices will be sent via email or phone (Message). Any remaining wallet points will not be refunded upon account termination.
Accounts found submitting fraudulent Aadhaar or PAN details will be terminated immediately.
If a chargeback is raised fraudulently, we will share verified Aadhaar and PAN details with banks and authorities for legal proceedings.
Termination Due to Minor Status: If a user is found to be a minor during eKYC verification, their account will be restricted, and they will no longer be able to use our services. Any remaining wallet balance they added before verification will be refunded, but payments for services/products already delivered will not be refunded.

13. Dispute Resolution and Compliance with Indian Law

Arbitration: Any dispute, controversy, or claim arising out of or relating to this contract, or the breach, termination, or invalidity thereof, shall be decided by arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996. The appointing authority shall be the Indian Council of Arbitration or any other recognized arbitration institution in India. The arbitration proceedings shall be conducted in English.
Jurisdiction: You agree to submit any dispute, controversy, or claim arising out of or in connection with the Services, including these Terms and Conditions, to the exclusive jurisdiction of the courts of India.
Compliance: You are responsible for ensuring compliance with all applicable laws, including cross-border transaction regulations where relevant.

14. Content Liability

We shall not be held responsible for any content that appears on your website. You agree to protect and defend us against all claims arising from your website. No link(s) should appear on any website that may be interpreted as libelous, obscene, criminal, or infringing on third-party rights.
